1. The agreement
These terms are the agreement between you and Barette AI LLC (3320 Treble Ct, Charlotte, NC 28262-2058, United States) for the Barette app, the Barette website and the Barette capture device. By creating an account or using the app you accept them. If you do not, do not use Barette.
Our privacy policy explains what we do with your data and forms part of this agreement.
2. Your account
- You must be 18 or older to hold an account.
- Give us accurate details and keep them current — orders and bookings depend on them.
- Your account is yours. Keep your password to yourself, and tell us at support@barette-ai-app.com if you think someone else has it.
- You are responsible for what happens on your account, unless it was our fault.
- One person, one account. Accounts may not be sold or transferred.
3. Using Barette
We grant you a personal, non-exclusive, revocable licence to use the app. You agree not to:
- Break the law with it, or use it to harm, harass or defraud anyone.
- Scrape, bulk-download or resell content, or hit our API with automated tools we have not authorised.
- Reverse engineer the app or the device firmware, except where the law says you may.
- Circumvent moderation, rate limits or a ban.
- Upload anything containing malware, or anything designed to break the service.
- Impersonate another person, a store or Barette itself.
4. Your content and Reels
You keep ownership of everything you post. Your photos, videos, captions and reviews stay yours.
To run the service, you give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (resize, transcode, thumbnail) and display your content inside Barette, for as long as you keep it posted. The licence exists so we can show your Reel to other users on the platform. It ends when you delete the content, apart from copies already in backups, which age out on the normal cycle, and copies other users lawfully saved before you deleted it.
We do not sell your content, licence it to third parties, or use it in advertising without asking you first.
Only post what you have the right to post. If a Reel uses music you do not own the rights to, our audio fingerprinting may block or remove it — and the rights holder may act too.
5. Content rules
These are not negotiable. Do not post:
- Child sexual abuse or exploitation material of any kind. This means immediate termination and a report to the authorities — see our child safety standards.
- Sexual content, nudity, or content that sexualises anyone.
- Harassment, hate speech, or attacks on people for who they are — including their age, gender, ethnicity, hair or appearance.
- Violence, threats, or content promoting self-harm.
- Dangerous "treatments", or medical claims presented as fact.
- Someone else's copyrighted work, or someone else's face or hair without their agreement.
- Spam, scams, fake reviews or counterfeit goods.
Report anything that breaks these rules from the Report control on a Reel, from Help & support in the app, or by writing to safety@barette-ai-app.com. We review reports and remove content that breaks the rules. We will tell you why if we remove yours, and you can reply if you think we got it wrong.
6. Marketplace purchases
- Products are sold by independent partner stores, not by Barette. The store is the seller and is responsible for the goods, their description and their delivery.
- Prices are shown in the store's own currency. What you see at checkout, including tax, is what the store will ask for.
- Orders today are settled cash on delivery or arranged directly with the store. Barette does not take card payments and never sees card details.
- An order is an offer to buy. It is accepted when the store confirms it.
- Cancellation and refunds are covered by our refunds and cancellations policy.
7. Bookings
- A booking is an appointment with an independent specialist or salon, made through Barette. The service itself is their responsibility.
- Turn up, or cancel in time. Both sides get notified when a booking is made, changed or cancelled.
- Repeated no-shows may cost you the ability to book.
- On-site bookings happen at an address you provide. Take the same care you would with any visitor.
8. Stores and specialists
If you sell or provide services through Barette, you also agree that:
- You have the legal right to sell what you list, and your listings are accurate — including price, currency and availability.
- You will honour confirmed orders and bookings, or cancel promptly and clearly.
- You will handle customer data you receive through Barette only to fulfil that order or booking, and in line with applicable data protection law.
- You are responsible for your own taxes, licences and insurance.
- We may remove a listing, a store or a specialist profile that breaks these terms or generates repeated complaints.
9. The Barette device
- The device is optional. The app works without it.
- Use it as documented. It contains a lithium-ion cell: do not puncture, crush, submerge or charge it from a supply outside its rating.
- Firmware updates may be required for the device to keep working with the app.
- Any hardware warranty is the one given at the point of sale, and it does not cover damage from misuse or unauthorised modification.
10. What the analysis is not
Barette's hair analysis is cosmetic guidance produced by software. It is not a medical diagnosis, and it is not a substitute for a doctor, dermatologist or trichologist. If you have hair loss, a scalp condition or any symptom that worries you, see a medical professional.
Recommendations are suggestions. Read product labels, patch-test where the label says to, and stop using anything that irritates you.
11. Intellectual property
Barette, its name, logo, app, website and device design are ours or our licensors'. Nothing in these terms transfers them to you. Source code published in our public repository is governed by the licence in that repository.
12. Suspension and termination
You can stop using Barette at any time and delete your account.
We may suspend or terminate an account that breaks these terms, puts other users at risk, or is used for fraud. Where we can, we will warn you first and explain why; for child safety, violence or fraud, we act immediately. You can appeal to support@barette-ai-app.com.
13. Disclaimers and liability
Barette is provided as it is. We work hard to keep it accurate and available, but we do not promise that an analysis will be right for every head of hair, that a recommendation will suit you, or that the service will never be interrupted.
We are not liable for the acts of independent stores or specialists, for content posted by other users, or for indirect or consequential loss. Where we are liable, our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
14. Governing law
These terms are governed by the laws of United States, and the courts of United States have jurisdiction over any dispute. If you are a consumer elsewhere, this does not remove the protection of mandatory consumer law in your own country.
Let us try to sort it out first: write to support@barette-ai-app.com and we will make a genuine effort to resolve it.
15. Changes
We may update these terms as Barette changes. The date at the top of the page shows the current version, and we will give notice in the app before a material change takes effect. Continuing to use Barette after that means you accept the new terms; if you do not, delete your account.
